NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. SWEEPSTAKES OPEN TO VETERINARY DOCTORS AND STAFF WORKING IN A VETERINARY OFFICE, WHO ARE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA AND ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY, WHO RECEIVE THE EMAIL INVITATION AND COMPLETES THE SURVEY. DO NOT PROCEED IF YOU DO NOT COMPLY WITH THE ABOVE ELIGIBILITY REQUIREMENTS. VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW.
ENTRY PERIOD: The BluePearl “Veterinary Practice Satisfaction Survey” Sweepstakes (the “Sweepstakes”) begins at 12:00:00 AM Eastern Time (“ET”) on April 30, 2024 and ends at 11:59:59 PM ET on May 20, 2024 (“Promotion Period”) and is further divided into three (3) Weekly Entry Periods (each a “Weekly Entry Period”). All Weekly Entry Periods begin on a Tuesday and end on a Monday. The Sponsor’s computer, or that of its designee, runs the official clock for the Promotion and will solely determine the time by which an entry is received.
ELIGIBILITY: This is a commercial Promotion and is not open to the general public. Sweepstakes open to [1] Veterinary Doctors and staff working in a veterinary office; [2] who are legal residents of the 50 United States including the District of Columbia and are eighteen (18) years of age or older at time of entry; and [3] who receive the email invitation and completes the survey (the "Entrant"). Employees of BluePearl Management, LLC ("BluePearl Holdings, LLC" or "BluePearl") (the "Sponsor"), its affiliates, subsidiaries, advertising and promotional agencies and Marden-Kane, Inc. (the "Administrator") (collectively "Releasees"), as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to participate or win a prize. Sweepstakes is subject to all applicable federal, state and local laws. Void in Puerto Rico and where prohibited by law.
HOW TO ENTER: There are two (2) ways to enter.
1- Complete the Survey: During the Promotion Period follow the link provided in your email, complete the survey, and click “finish.” Personal information collected from entrant is used only for the purpose of the Sweepstakes and to notify winners and will not be re-used, sold or shared in any manner, unless entrant opts-in to receive further information on Sponsor’s products and promotions. Upon completion and receipt of the survey, eligible entrants will receive one (1) entry into the sweepstakes.
2- Mail-In Entry without completing the survey: Hand-print your name, name of the practice, address, city, state, zip code, daytime phone number, and email address (mandatory) on a plain 3”x5” piece of paper, place in a stamped envelope and mail to: BluePearl Sweepstakes, 2950 Busch Lake Blvd., Tampa, FL 33614. Mail entries must be postmarked by May 20, 2024 and received by May 29, 2024. Limit of one (1) entry per mailing envelope. Envelopes containing multiple entries will be disqualified. Sponsor is not responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated, or postage-due mail. Photocopies, mechanically reproduced, forged or altered mailed entries and facsimiles are void. Incomplete or illegible entries are not eligible. All entries become the property of the Sponsor and will not be returned. No entries may be submitted on behalf of another person.
LIMITATIONS: There is a maximum limit of one (1) Entry per person for the entire Promotion Period regardless of method of entry. Entries received in excess of the entry limit stated herein will be disqualified. Entries may only be submitted by a single Entrant. Multiple Entrants are not permitted to share the same account. Any attempt by any Entrant to submit more than the stated number of entries by using multiple/different accounts, identities, or any other method will void that Entrant's entry and that Entrant may be disqualified. Entries that do not comply with these Official Rules, as determined in Sponsor’s sole discretion, will be disqualified from the Sweepstakes. By submitting an Entry, Entrant acknowledges that he/she has read, understands and agrees to the Official Rules.
In the event of a dispute over the identity of a potential winner, the entry will be declared made by the authorized holder of the email address used for entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of email address. The “authorized account holder” is the natural person assigned to the account by the applicable service provider. It is the sole responsibility of the Entrant to notify the Sponsor in writing if the Entrant changes his or her email address during the Sweepstakes Period. Proof of submission of an Entry does not constitute proof of delivery of Entry.
RANDOM DRAWINGS: A random drawing to select Twenty (20) Weekly Period prize winners will be conducted on or about the drawing dates stated in the Entry & Drawing Periods Chart below (the “Chart”) from among all eligible entries received by the end date for that Weekly Period and the non-winning entries received during prior Weekly Periods. For purposes of clarity automatic survey entries will be included in the Weekly Drawing based on the date which the survey was completed, and mail-in entries will be included in the Weekly Drawing based on the post mark date on the mail-in entry. All drawings will be conducted by Administrator, who is an independent judging organization whose decisions are final and binding in all matters relating to the Sweepstakes.

PRIZES: Sixty (60) Prizes (20 prizes per Weekly Period): $100 gift card. Approximate Retail Value (“ARV”): $100.00 each. Total Approximate Value of all Prizes: $6,000.00. The gift card type is determined by Sponsor at time of award. Gift Card terms and conditions, and bylaws for use and redemption will apply. All taxes on a prize and other expenses related to acceptance or use of the prize are the sole responsibility of the winner. The odds of winning depend on the total number of eligible entries received for each Weekly Entry Period. There is a limit of one (1) prize per practice.
WINNER NOTIFICATION: Potential Prize Winners will be notified via e-mail at the email address provided at time of entry or via regular mail on or about May 31, 2024. Potential winners may be required to complete and sign an Affidavit of Eligibility and Liability Release and; where legal, a Publicity Release (collectively the “Affidavit”) which must be returned within five (5) days from prize notification date or the prize will be forfeited and awarded to an alternate potential winner. If the potential Winner (i) cannot be contacted after a reasonable attempt has been made by Administrator (as determined in Sponsor’s sole discretion); (ii) fails to timely return the required paperwork without alteration and in the form presented by Administrator; (iii) refuses the prize; and/or (iv) the prize or prize notification is rejected or returned as undeliverable, such potential winner forfeits all rights to be deemed a winner in the Sweepstakes and receive the prize, then that potential prize winner will be disqualified and an alternate winner will be selected through a random drawing by the Administrator from the remaining entries. Prizes must be accepted as awarded. If the prize is won by an eligible individual who is not of the legal age of majority in the state of residence (“minor”), the required documents must be confirmed and signed by winner’s parent or legal guardian.
CONDITIONS OF ENTRY: By participating, entrants agree to comply with these Official Rules including all eligibility requirements. Sponsor reserves the right to disqualify entrants who violate these Official Rules or interfere with this Promotion in any manner. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated entry software is prohibited. Electronically reproduced, illegible, incomplete or inaccurate entries are void. In case of a dispute as to the “entrant”, entrant is the authorized account holder of email address. Releasees and all of their officers, directors, shareholders, employees, and agents are not responsible for incorrect or inaccurate transcription of entry information, or for any human or printing error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, inability to submit the online registration form, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this promotion, or for late, lost, stolen, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. If, in the Sponsors’ opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Administrator reserves the right to void any entries at issue and/or to suspend, modify or cancel or terminate this Sweepstakes, in whole or in part, at any time without notice and award the prizes in a random drawing from among all non-suspect eligible entries received as of the termination date. Caution: Any attempt by an entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.
GENERAL CONDITIONS: By accepting a prize, winner or, if a minor in their state of residence, their parent or legal guardian, consents to the use of his/her name, city/state of residence, photograph, visual and/or audio likeness for advertising or promotional purposes by Sponsor, and its designees, including but not limited to the posting of winner’s name on the Sponsor’s website(s), in a Winners List or other online announcements, without additional compensation, permission or notification except where prohibited by law. Participants, or, if minors, their parents or legal guardians agree to release indemnify and hold harmless Releasees and their respective employees, officers, directors and shareholders from any claims, actions, injury, loss or damage of any kind resulting from participating in this Sweepstakes or from the acceptance or use of any prize awarded. U.S. law governs this Sweepstakes. Notice to online participants: Internet access and usage charges applicable to a participant’s account, including local, long distance, 800/888* access charges and/or any usage charges applicable under participant’s Internet pricing plan and any applicable taxes will continue to apply while a participant is online in connection with this Sweepstakes, and will be the sole responsibility of such entrant. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. If, in the Sponsor’s opinion for any reason, the Promotion is not able to run as planned for reasons which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, including soliciting of applications in a manner inconsistent with Sponsors’ policies or procedures or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, including any other factors beyond Sponsor’s reasonable control such as a Force Majeure (e.g., war, riots, terrorism, civil unrest, strikes, blackouts, supply shortages, order of governmental authority,) an “act of God” (e.g., natural disasters, weather, etc.) or an unforeseeable health event (e.g. pandemic or epidemic), then the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion in whole or in part, without further liability to the Entrants or third parties. In the event the Promotion is cancelled prior to the stated end date, a notice will be posted on the Promotion web site; and Sponsor reserves the right to conduct the drawing and award Prizes from among all eligible non-suspect Entries received prior to the cancelation of the Promotion.
WHO WON: To receive the list of the Winners send an email with the subject line: BluePearl Veterinary Practice Satisfaction Survey Sweepstakes to [email protected]. Requests must be received by June 6, 2024. The list of Winners will be sent once the drawing has been conducted and winners confirmed.
GOVERNING LAW/JURISDICTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Sweepstakes shall be governed by the laws of the state of Florida, without giving any effect to any choice of law or conflict of law rules. Any dispute shall be resolved in a court of law in Hillsborough County, Florida.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
